Terms of Use

1. General provisions

1.1. These terms govern the use of the Erinneriq service (erinneriq.com) — notes, drawings and canvases in your browser. The service is provided by ФОП Коток І.М. (the “Provider”).

1.2. By using the service, you accept these terms, the Public Offer and the Privacy Policy.

1.3. The Provider may amend these terms by publishing a new version on this page. We will notify you of material changes by email in advance; your continued use of the service constitutes acceptance.

2. What the service provides

2.1. Browser-based access to creating and storing notes, lists, drawings and canvases and to exporting them to PDF and SVG, including:

• a web interface on computers, tablets and phones;
• data storage with daily backups;
• updates and new features;
• answers to your questions by email.

2.2. The service is a tool. It is not a substitute for legal, financial or other professional advice.

3. Account

3.1. You sign in with a one-time code sent to your email address. Do not share codes or access to your email with other people.

3.2. Provide your own valid email address: sign-in codes and important notices are sent to it.

3.3. The service may be used by persons aged 16 or over; younger persons may use it only with the consent of their parents or legal guardians.

4. Rules of use

4.1. When using the service, you must not:

• violate the law or the rights of others;
• upload malware or unlawful content;
• interfere with the operation of the service, including by using bots or scrapers or by creating excessive load;
• attempt to access other people’s data or accounts.

4.2. If these rules are violated, the Provider may restrict or terminate access.

5. Fees

5.1. The service is currently free of charge. If paid plans are introduced, we will notify you at least 1 month in advance — by email and on the website. Nothing will be charged without your explicit consent. For details, see the “Pricing” page.

6. Your data and your rights to it

6.1. Everything you create and upload belongs to you. The Provider uses it solely to operate the service: to store it, display it to you, synchronize it across your devices and back it up.

6.2. All rights to the software, the design and the name Erinneriq belong to the Provider.

7. Limitation of liability

7.1. The service is provided “as is” and “as available”. We strive to keep it running without interruptions or errors but cannot guarantee this.

7.2. To the extent permitted by law, the Provider is not liable for failures on the part of hosting providers, communication networks or other third parties, for acts of third parties or force majeure, or for lost profits and indirect damages.

7.3. Keep your own copies of important data — for example, export your canvases to PDF or SVG.

8. Termination

8.1. You may stop using the service at any time and request deletion of your account by writing to [email protected].

8.2. Once your account is deleted, your data is removed from the service, and after 7 days from the backups as well.

9. Disputes

9.1. Please first send a complaint to [email protected]; we will consider it within 15 calendar days.

9.2. If no agreement is reached, the dispute shall be resolved by a court in accordance with the laws of Ukraine. If you are a consumer in the European Union, you retain the rights granted to you by the mandatory provisions of the law of your country.
